Agreement between you and Tradavity
By accessing or using Tradavity ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
We offer a 30-day money-back guarantee for new Pro subscriptions. Contact support@tradavity.com within 30 days of your first payment for a full refund.
New users may receive a 7-day free trial of Pro features. No payment is required during the trial. After the trial ends, you will be downgraded to the Basic plan unless you subscribe.

You retain ownership of all content you upload to Tradavity (trades, journal entries, screenshots, etc.). By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service.
You are responsible for ensuring your content does not violate any laws or third-party rights. We may remove content that violates these Terms.
Tradavity offers optional AI-powered features (text correction, smart formatting, note generation, in-app search, AI Chat). By enabling AI features and granting consent in Settings:
You may provide your own API keys for OpenAI and/or Anthropic. By doing so:
If you are a consumer in the European Union, you have the right to withdraw from a paid subscription within 14 days of purchase without giving any reason (in accordance with § 356 BGB and the EU Consumer Rights Directive 2011/83/EU).
To exercise the right of withdrawal, you must inform us by email at support@tradavity.com of your decision to withdraw by means of a clear statement (e.g., a letter sent by email). You may use the following model withdrawal form, but it is not obligatory:

If you begin using Pro features before the 14-day withdrawal period expires (e.g., by accessing premium content immediately after subscribing), you expressly consent to the immediate provision of the digital service and acknowledge that your right of withdrawal expires once the service has been fully provided during the withdrawal period (§ 356 Abs. 5 BGB).
In addition to the statutory withdrawal right, we offer a 30-day money-back guarantee for new Pro subscriptions (see Section 4.3).
You may delete your account at any time from Settings. Account deletion includes a 14-day grace period during which you can cancel the deletion request. After 14 days, your data is permanently deleted.
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for other reasons at our discretion. We will attempt to notify you before termination when possible.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Trading involves substantial risk of loss. Tradavity is a journaling tool and does not constitute financial advice. Past performance recorded in the journal does not guarantee future results. You are solely responsible for your trading decisions.
To the maximum extent permitted by law, Tradavity and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless Tradavity, its operators, and affiliates from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
The Tradavity name, logo, and all related trademarks, service marks, and branding are our property. The Service's code, design, and documentation are protected by copyright and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.
Certain components of the Service, including charting technology, are provided by third-party licensors. You must not use any charts, data visualizations, or other content displayed within the Service for commercial purposes without first obtaining the necessary license from the respective rights holder. Chart technology is provided by TradingView.
We may modify these Terms at any time. We will notify you of significant changes by email or through the Service. Your continued use after changes constitutes acceptance of the new Terms. If you do not agree with changes, you may terminate your account.
These Terms are governed by the laws of Germany. Any disputes shall be resolved in the courts of Trier, Germany, unless mandatory consumer protection laws in your country of residence provide otherwise.
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
